1. Acceptance of Terms
By accessing or using GrowthOS, you agree to be bound by these Terms. If you do not agree, do not use the service.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.
3. Intellectual Property
a) What You Own
You retain all rights to the content you upload, the assets you provide, and the content GrowthOS generates for you (scripts, storyboards, videos, and audio). GrowthOS claims no ownership over your outputs.
b) What We Own
GrowthOS owns the underlying platform, the base AI models (before they are personalised with your data), our brand, and our original documentation.
c) License for Improvement
By using GrowthOS, you grant us a limited, revocable, non‑transferable license to use your prompts and generated content solely to:
- Provide the service to you.
- Improve the AI models that personalise your experience.
- Improve the global AI models, unless you opt out (see our Privacy Policy).
This license ends when you delete your account or opt out. We will remove your data's influence from the global models as described in our Privacy Policy.
d) Opt‑Out Rights
You may opt out of having your data used for global model improvements at any time from your Account Settings. Opting out does not affect your ability to use GrowthOS or the quality of your personalised AI models.
4. Limitation of Liability
GrowthOS is provided "as is". We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, to the fullest extent permitted by law.
5. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the federal or state courts located in Delaware.
6. Third‑Party Platforms
GrowthOS relies on application programming interfaces (APIs) and services provided by third‑party social media platforms, including but not limited to Instagram (Meta), TikTok, X (formerly Twitter), YouTube, and Facebook. These APIs are owned, operated, and maintained entirely by those third parties, and GrowthOS has no control over their availability, functionality, or policies.
From time to time, third‑party platforms may modify, restrict, suspend, or discontinue their APIs—in whole or in part—with little or no prior notice. Such changes may temporarily or permanently affect the features, performance, or availability of GrowthOS.
GrowthOS shall not be held liable for any loss, interruption, or reduction in service caused by third‑party API changes. Such events are beyond our reasonable control and do not constitute a breach of any agreement between you and GrowthOS. We will make commercially reasonable efforts to adapt to platform changes as quickly as possible, but we cannot guarantee uninterrupted service when a third‑party platform alters or withdraws its API.
By using GrowthOS, you acknowledge that third‑party platform availability and policies are subject to change at any time, and you accept that GrowthOS cannot be held responsible for the impact of those changes on your account, content, or campaigns.
